A brief description of the process of procurement

Procuring and processing Planning Analytical Materials of the Region and Municipality (hereafter UAP), Development Principles of the City of Prague (ZUR) and the Land Use Plan of the City of Prague (ÚPn) act in accordance with Act No. 183/2006 Coll. from 14 March, 2006, on Town and Country Planning and Building Regulations (the Building Act) and Decree No. 500/2006 Coll. on planning analytical materials, urban planning documentation and the method of recording urban planning activity, which modify in more detail requirements of the content of planning analytical materials, content of urban planning documentation (such as ZUR and ÚPn), including requirements for documents related to acquiring and assessing the effects on the sustainable development of the territory and the maintenance of urban planning documentation, and materials for recording urban planning activity.

The Department of Land Use Planning of the Prague City Hall procures UAP of the City of Prague, ZUR of the City of Prague and ÚPn of the City of Prague. The City Development Authority Prague processes them.

Planning Analytical Materials of the City of Prague (UAP)


UAP are Urban Planning Materials (UPP) which determine and assess the land status and development, its value and limitations to land changes in order to protect public interests resulting from legal regulations or determined based on special legal regulations or resulting from the land characteristics (hereafter “limits of the land use”).
UAP also include intentions to carry out changes in the territory, determining and assessing sustainable development of the territory and determining problems to solve in urban planning documentation (ÚPD), (hereafter “analysis of sustainable development of the territory”).
UAP are one of the materials for ÚPD procurement, mainly ÚPn.

Development Principles of the City of Prague (ZUR) – proposal part

ZUR are urban planning documents processed on the basis of UAP. In the City of Prague, the priority requirement is acquiring ZUR as a basic planning document, defining the goal and principles of spatial development of the city, and creating a basic framework for processing the new Land Use Plan of the City of Prague (see Development Principles of the City of Prague )
ZUR also include assessment of the effects of ZUR on the sustainable development of the territory – SEA

Process of ZUR procurement

Specification of ZUR of the City of Prague was discussed by the respective bodies, city boroughs, the Central Bohemia Region, and the Ministry of Regional Development of the Czech Republic and approved by Prague Municipal Assembly Resolution No. 11/52 on 29 November, 2007.
On 17 March, 2008 a joint discussion of the proposal of the Development Principles of the City of Prague (ZUR) took place. The joint discussion of the proposal of ZUR concerned only notified organisations.
Public proceedings about the modified and assessed proposal of ZUR which concerns other organisations, individuals and legal entities will take place. The procurer will make sure that, during the 30-day period from the delivery date of the public decree, the ZUR proposal was available for public review. Anyone can make queries at the public proceedings at the latest. Representatives of the public can raise objections with their reasoning and at the same time must specify the land to which the objection was raised. Late queries and objections will not be considered.
If there is a significant modification of the ZUR proposal based on the public proceedings, the ministry will assess it and public proceedings will take place again with the participation of respective bodies.
Queries can be raised at the repeated public proceedings at the latest.

Land Use Plan of the City of Prague (ÚPn)

ÚPn of the City of Prague is an urban planning document which specifies and develops goals and tasks of urban planning in accordance with ZUR of the City of Prague.

ÚPn of the City of Prague is an urban planning document which specifies and develops goals and tasks of urban planning in accordance with ZUR of the City of Prague. ÚPn of the City of Prague determines the basic plan for the development of the territory of the City of Prague, protection of its value, its area and spatial lay-out (hereafter “urban planning”), lay-out of landscape and public infrastructure plan. Further, specific built-up land, areas and corridors, mainly developed areas and areas determined for a change of current development (hereafter “area of redevelopment”), for publicly beneficial facilities and measures and for land reserves and determining conditions for the use of those areas and corridors (see the Land Use Plan of the City of Prague).

Process of Procuring the Land Use Plan of the City of Prague

The procurement was initiated on the basis of Prague Municipal Assembly Resolution No. 7/1 of 31 May 2007.
The City Development Authority Prague drew up the proposal specification of the Land Use Plan of the City of Prague , which was exhibited for public viewing per Public Ordinance – Notification , from 3 August to 1 September 2007.
The Prague Municipal Assembly approves the land use plan specification.
According to the approved specification, the procurer ensures the creation of the Draft Land Use Plan and assessment of effects on sustainable development of the territory.
The procurer announces public proceedings regarding the Draft Land Use Plan by public ordinance 15 days in advance and ensures that the Draft Land Use Plan is exhibited for public viewing at places determined by the ordinance for 30 days from the day of the execution of the public ordinance. Within 15 days of the public proceedings, anyone can submit remarks and owners their objections.
The Prague City Council will discuss the assessment of effects on sustainable development.
Based on the results of the discussion on the Draft Land Use Plan, the procurer will elaborate a proposal of instructions for elaborating the Proposal for the Land Use Plan which the Prague Municipal Assembly will approve.
According to the approved instructions for elaborating the Proposal for the Land Use Plan, the procurer will provide elaborating of the Proposal for the Land Use Plan for Prague.
A joint discussion on the Proposal for the Land Use Plan involving only notified organisations will take place.
The Prague City Council will discuss the assessment of effects on sustainable development.
The procurer announces public proceedings regarding the Proposal for the Land Use Plan by public ordinance 15 days in advance and ensures that the Proposal for the Land Use Plan is exhibited for public viewing at places determined by the ordinance for 30 days from the day of the execution of the public ordinance. Remarks may be submitted no later than the public proceedings. Owners of plots of land and buildings and representatives of the public can submit objections to the Proposal for the Land Use Plan with their reasoning, information from the real estate cadastre and specifying the territory in question.

Alterations to the Current Land Use Plan of the City of Prague

Suggestions for new alterations to the current Land Use plan are not being accepted at the moment.

Intervention in a binding part of the approved Land Use Plan of the City of Prague changing its content is considered an alteration.

The Prague Municipal Assembly issues the Land Use Plan of the City of Prague and alterations to the Land Use Plan of the City of Prague. The Department of Land Use Planning of the Prague City Hall is the procurer of the Land Use Plan of the City of Prague and of alterations to the Land Use Plan of the City of Prague.

Procuring alterations to the Land Use Plan of the City of Prague


The procurement of alterations is in accordance with Act No. 183/2006 Coll. on Town and Country Planning and Building Regulations (the Building Act), as amended, Section 55. The specification for conditions of the City of Prague is granted by Prague Municipal Assembly Resolution No. 33/07 of 4 October 2001 and Prague City Council Resolution No. 1156 of 26 October, 1999 and No. 0362 of 4 April 2000.

The Prague City Council recommended in its resolution the procurement of alterations to the Land Use Plan of the City of Prague through an abbreviated process. Prague Municipal Assembly will determine the process of procuring a particular wave of alterations.

Records of Alterations to the Land Use Plan of the City of Prague


Records of approved alterations to the Land Use Plan of the City of Prague are in every phase implemented by a general administrative measure which amends Decree No. 32/1999 Coll. of the City of Prague on the Binding Part of the Land Use Plan of the City of Prague.

The procurer, The Department of Land Use Planning of the Prague City Hall, maintains records of approved and rejected alterations to the Land Use Plan of the City of Prague, including relevant materials and the process of their procurement.

Records of approved alterations will be carried out in drawing no. 4. Approved alterations to the drawings of the Land Use Plan of the City of Prague are not drawn, but are tracked in the so-called transparencies and in electronic form (CD). If the drawn alterations are not clear in the transparencies, the procurer can decide to prepare a new version of the drawing.

Possibility of information about alterations to the Land Use Plan of the City of Prague:

  • A measure of general administrative measure is issued for every phase of alterations and completes Decree No. 32/1999 Coll. of the City of Prague on the Binding Part of the Land Use Plan of the City of Prague. Only approved alterations to the Land Use Plan of the City of Prague are stated here.
  • Usnesení Zastupitelstva hl. m. Prahy. Jsou zde uvedeny všechny návrhy změn, které byly Zastupitelstvu předloženy ke schválení včetně změn neschválených, nebo změn, které nemohly být Zastupitelstvu předloženy ke schválení (záporné stanovisko dotčeného orgánu, rozpor návrhu změny s platnými předpisy) s výsledky hlasování.

  • Information system SEA on the web pages of the Ministry of the Environment of the Czech Republic and Cenia – announcement, conclusion of screening procedures and the course of the SEA assessment up to the final opinion of a relevant body – Environmental Department of the Prague City Hall, are also published in a national central information system for assessing effects on environment.

 

Modifications to the Current Land Use Plan of the City of Prague


Intervention in the directive of the Land Use Plan of the City of Prague that changes its content is considered a modification.
The procurer of the Land Use Plan of the City of Prague decides on the modification of the Land Use Plan of the City of Prague.

Records of modifications of the Land Use Plan of the City of Prague


1. The relevant building authority maintains records of modifications to the Land Use Plan of the City of Prague for its administrative territory.

2. The Department of Land Use Planning of the Prague City Hall maintains records of approved and rejected modifications to the Land Use Plan of the City of Prague, including corresponding materials.

2.1. The Department of Land Use Planning of the Prague City Hall assesses once a year (always on 31 December of the corresponding calendar year) the extent of approved modifications and gathers materials to update the relevant drawings of the Land Use Plan of the City of Prague. The update of the relevant drawings is carried out together with the implementation of the most recent phase of approved alterations to the Land Use Plan of the City of Prague.

2.2.Once each year, the Department of Land Use Planning of the Prague City Hall issues a list of approved modifications to the territory of the City of Prague for the relevant calendar year and passes them on to all city boroughs and building authorities by 31 March of the following year.

 

Process of Arranging an Exceptionally Permitted Construction


On the basis of Section 85 of Act No. 183/2006 Coll., on Town and Country Planning and Building Regulations (the Building Act), subsequently amended, the City of Prague also takes part in planning permit proceedings on arranging exceptionally permitted construction. The City of Prague carries out this process as follows:

1) The relevant building authority responsible for permitting exceptional constructions will ask the following authorities for an opinion on permitting an exceptional construction:

a) The City Development Authority Prague,

b) The borough where the exceptionally permitted construction is to be located.

2) If the City Development Authority Prague shares the opinion of the city borough, the relevant building authority will issue a positive or negative decision (resp. building permit), according to the nature of the corresponding opinions.

3)If the City Development Authority Prague is not in agreement with the city borough, the negative opinion of one of the above-mentioned parties will be applied in terms of the administrative procedure as a remark of a participant in the proceedings, and the building authority will proceed in the matter in accordance with the Building Act.
